Contract/Terms & Conditions
1. The Booking
Your contract is with Caper Travel Company Pvt. Ltd.(Company). This contract comes into force when a tour of your(Traveler/Customer) choice is confirmed by the Company and it has received your booking form along with booking amount deposit. The travelers are required to furnish all details needed as per booking form and its relevant section must be correctly and fully completed.
2. Deposit
Upon finalization of tour, a booking amount deposit of at least 50% of the tour cost per person be paid to the company.
3. Payment
All payments can be made to Caper Travel company Pvt.Ltd., by Credit card or electronic money transfer. There will be a surcharge of 3% if you make the payment by credit card – which will be added to your invoice cost. For all confirmed bookings, you are required to pay the full tour cost amount being payable on or before 10 working days of tour start date.
4. Tour Cancellation
If you or any member of your group wishes to cancel the tour, you or your group member must notify the Company in writing. In this regard, the date of communication to the Company and on the date the cancellation notice is received by the Company in writing, shall be treated as the actual date of cancellation of the tour. The person who has signed the booking form must also sign/endorse the letter/notice of cancellation. Tour cancellation incurs administrative cost and retention charges by hotel. Hence, the cancellation charges shall be applicable and charged as per the following scale:

Also above cancellation policy may be differ depending on the effective cancellation policy applicable by the various supplier and final cancellation policy would be communicated at the time of making the final booking.
Note : Above cancellation policy will not be applicable for Train and Flight tickets booking which is as per the airline and railways policy.
5. If you change your booking
After your confirmation invoice has been issued and if you wish to change your travel arrangement in any way, for your chosen departure date or accommodation, Company will do utmost to make these changes, but it may not always be possible and may attract charges as applied by the respective suppliers
6. Liability
Caper Travel Company Pvt. Ltd. accepts the liability for those arrangements for your holiday/tour, which are wholly within its control and therefore, accept liability to clients for the negligence of its agents, which include its employees. However, company would like to draw your attention to the following circumstances, which fall outside its direct control or where for some reason company is not prepared to accept liability.
The Company shall, in no circumstances whatsoever be liable to the client or any person travelling with him or her for: Any death, personal injury, sickness, accidents, loss delay, discomfort, increased expenses, consequential loss and / or damage or theft howsoever caused;
Any act, omission, default of any independent contractor or other person or by any servant or agents employed by the company who may be engaged or concerned in the provision of accommodation, refreshment, carriage facility or service for the client or for any person travelling with him howsoever caused. Caper Travel Company Pvt. Ltd (INDIA) is unable to take liability for commercial arrangements being out of its control such as natural disasters, industrial disputes, reason of threat or war, lockdown, riots, civil strife, terrorist activities, technical problems to the transport, extreme weather conditions, closure of the airports and sea ports and similar event out of our control, or are due to unusual and unforeseeable circumstances beyond your control.
The company does not own or control hotels, coach or other facilities mentioned in the tour. As an operator of the package tour therefore, we cannot be held liable.
a) Where there has been no fault on the part of the company, supplier or agents.
b) Where the failures in performance of the contract are attributable to the customer.
c) Where the failures are attributable to a third party not connected with the provision of the holiday/tour and are unforeseeable or unavoidable.
d) Where the failures are due to unusual and unforeseeable circumstances beyond control.
e) Where the failures are due to an event which you or your supplier even with all due care could not foresee or foretell.
f) in case of any force majeure conditions.
However, the Company makes all reasonable steps in ensuring the services matching the industry standards. The information provided to the customer has been compiled with all reasonable care and is correct to the best knowledge of the company and is published in good faith.
The maximum liability of company under any case shall be maximum to the total cost of the package charged by the company or total amount paid the customer, whatsoever.
7. Complaints
Although Company makes all efforts to ensure an enjoyable and trouble free tour but, occasionally plans may go wrong. Should you have any complaint, please do report the issue to Company’s Travel Manger at the time who will take all necessary steps possible to resolve the matter immediately. Any disputes between clients and Caper Travel Company Pvt. Ltd. Shall be governed by Jurisdiction of New Delhi, India as per law of the land.
8. Domestic Airline luggage allowance
Please note that all the domestic carriers in India allow up to 15 Kg carrier luggage and 7 Kg hand luggage, if any guest carries more than the allowed limit, then one has to pay airline concerned directly and the company shall not be responsible in any manner for such matters. These allowances will be subject to change by airlines.
9. Passports & Visas
To travel Neighbouring countreis from India you would need 06 months valid passport and for certain countries visa will require. And processing of Passport and Visa are not included in the tour cost.
10. HEALTH
The Traveler acknowledges that Overseas Trip may involve considerable physical exertion including walking for long distances or long waiting period or other physical activities of like nature which are beyond the control of the Company.
The Traveler undertakes that he/she is physically fit to undertake the above said activities and also that he/she does not suffer from any medical issues or infirmity preventing him/her from undertaking the requisite physical activities.
Company reserves the right to request the Traveler for a medical certificate providing for his/her physical fitness for the Overseas Trip. This may include requirements for immunization or vaccination as specified by the Embassy or the Consulate of the country/countries to which the Overseas Trip is being scheduled.
Traveler acknowledges that it is mandatory to purchase overseas medical insurance policy and other appropriate travel insurance policies, at his/her own cost, to cover the risk for life and his/her property during the period of Overseas Trip on his/her own. Traveler acknowledges that Company shall not be responsible and liable for any theft, damages, bodily injury and loss of life, whatsoever.
Company shall make best endeavors to assist the Traveler during medical emergencies and facilitate the return of the Traveler to his/her home country. However, Company shall not be in any way responsible for any loss of life or property in any manner, whatsoever. Company shall not further entertain any refund claim for the pending duration of the Overseas Trip which could not be continued due to medical reasons.
The Trip/tour Quote does not include cost of insurance premium towards insurance policies. Accordingly, Traveler is strongly advised to purchase the appropriate medical insurance policies.
11. Early Check-in / Late Check –out
Please note that standard check-in / Checkout time in most of the hotels are 1400 Hrs. to 1300 Hrs (IST). Therefore, cost of Early check-in or Late check-out is not included in the tour cost. Company can always make a request for early check-in or Late checkout if required but without any guarantee and that entirely depends upon the policy of the hotel, time of the year and availability of the room.
12. Extra Uses of our Vehicle
Please note that cost of the vehicle (car / coaches with the driver) is not included in the tour cost like :
- Usage of vehicle like after transfer or after sightseeing untill or unless it is mentioned in the itinerary.
13. Rights to amend the itinerary if required
Tour once commenced will strictly go as per the finalized itinerary. In case of events and circumstances beyond control, Company reserves the right to change all or any parts of the contents of the itinerary for safety and well-being of its guests/passengers.
14. Surcharge
The Price of your travel arrangement are subject to surcharges in case of sudden hike in fuel prices, schedule airfare and any taxes levied by the government. Even in this case, Company will try to absorb an amount of 2%, amount exceeding over 2% will be surcharged.
15. General Terms & Conditions
Caper Travel Company Pvt. Ltd. reserves the right, at any time, without prior notice and liability and without assigning any reason whatsoever, to add/alter/modify/change or vary all of these terms and conditions or to replace, wholly or in part, this offer by another offer, whether similar to this offer or not, or to extend or withdraw it altogether. Caper Travel Company Pvt. Ltd. shall be the sole authority for interpretation of these terms.
Caper Travel Company Pvt. Ltd. shall not be liable for any loss or damage arising due to force majeure events.
In the event of any misuse or abuse of the offer by the Customer or travel agent, Caper Travel Company Pvt. Ltd. reserves the right to deny the offer or cancel the booking at its sole discretion.
Caper Travel Company Pvt. Ltd. shall not be liable for any indirect, punitive, special, incidental or consequential damages arising out of or in connection with the offer.
The above terms and conditions shall be part and parcel of the User Agreement .
